1. Who you are contracting with
Classbook is operated by MYLUMERA TECHNOLOGIES OPC (“Classbook”, “we”, “us”). By creating an account or continuing to use the service you agree to these terms. If you are using Classbook on behalf of an institution, you confirm you have authority to bind that institution; otherwise you confirm you are of legal age to enter into this agreement.
2. The service
Classbook is a web application for instructors to manage class records: student rosters, attendance, class participation, quizzes, major examinations, grade transmutation, a reusable materials and question library, and exports. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have selected.
3. Your account
You must provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us at support@mylumera.net if you suspect unauthorised access.
4. Acceptable use
You must not: use the service unlawfully; commit fraud or send spam; infringe anyone's intellectual property; upload malware; probe, scan or otherwise interfere with the security or integrity of the service; scrape the service; reverse engineer it; resell or redistribute it; or circumvent technical or plan limits.
You are responsible for the student data you enter and for handling it lawfully under the rules of your institution and applicable data protection law.
5. Intellectual property
We retain all ownership of the service, its software, documentation and branding. You retain ownership of the content and records you upload, and grant us a limited licence to host and process that content solely to provide the service to you.
6. Service level
We work to keep Classbook available and accurate, but we do not guarantee uninterrupted or error-free performance. Grades and computed results should be reviewed by the instructor before being released or submitted to an institution.
7. Payment and subscription terms
Paid plans are billed monthly or annually in advance at the prices shown on the subscription page, and renew automatically until cancelled. Payment, billing, taxes, cancellation and refund mechanics are governed by Paddle’s Buyer Terms. Our Refund Policy also applies.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
8. Trials and access
New accounts receive a 30-day free trial with full functionality and no card required. When the trial ends without a subscription, your data remains visible and exportable but creating and editing records is disabled until you subscribe.
9. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time. After termination you may request an export of your data for 30 days, after which it may be deleted.
10. Warranties and liability
To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury where the law does not permit exclusion.
You indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
11. General
These terms are governed by the laws of the Republic of the Philippines, and the courts of the Philippines have jurisdiction. You may not assign this agreement without our consent; we may assign it in a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. We may update these terms and will post the revised date above.
